Terms of Service

1. Acceptance of Terms
By accessing or using Velko ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Velko LLC.
2. Description of Service
Velko is an AI-powered nutrition tracking application that allows you to:
- Log meals via photo or text for AI-powered nutritional analysis
- Track calories, macronutrients, and dietary goals
- Monitor weight progress and activity levels
- Receive personalized coaching insights from Cam, your AI nutrition companion
The Service is available on iOS and via web browser at velko.ai.
3. Account Registration
- You must be at least 13 years old to create an account
- You must provide accurate and complete information during registration
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use of your account
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Upload content that is harmful, offensive, or infringes on others' rights
- Attempt to reverse engineer, decompile, or disassemble the Service
- Use automated systems (bots, scrapers) to access the Service
- Interfere with or disrupt the Service or its infrastructure
- Impersonate another person or entity
- Share your account credentials with others
5. AI-Generated Content Disclaimer
IMPORTANT: Velko uses artificial intelligence to analyze food and provide nutritional estimates. You acknowledge and agree that:
- Nutritional analysis results (calories, macros, etc.) are AI-generated estimates and may not be perfectly accurate
- Velko is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease
- Coaching insights and recommendations are for informational purposes only
- You should consult a qualified healthcare provider or registered dietitian before making significant dietary changes
- Velko should not be used as a substitute for professional nutritional or medical advice
- AI analysis may not accurately identify all ingredients or allergens in food — if you have food allergies, always verify ingredients independently
6. User Content
- You retain ownership of all content you upload to Velko (photos, text descriptions, etc.)
- By uploading content, you grant Velko LLC a limited, non-exclusive license to process, store, and analyze your content solely for the purpose of providing the Service
- You are responsible for ensuring you have the right to upload any content you submit
- We may remove content that violates these terms
7. Intellectual Property
- Velko, the Velko logo, Cam the Chameleon mascot, and all associated branding are the property of Velko LLC
- The Service's code, design, and features are proprietary
- You may not copy, modify, distribute, or create derivative works from the Service
- Nothing in these terms grants you any right to use our trademarks or branding
8. Privacy
Your use of the Service is also governed by our Privacy Policy, available at velko.ai/web/privacy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
9. Subscription and Payments
Velko offers a free tier with limited features (1 AI meal analysis per day) and a premium subscription ("Velko Premium") with unlimited access to all features.
9.1 Pricing
- Monthly: $9.99 per month
- Annual: $79.99 per year (save 33%)
9.2 Free Trial
- New subscribers are eligible for a 7-day free trial on either plan
- You will not be charged during the free trial period
- If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate
9.3 Auto-Renewal
- Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period
- Your Apple ID account or payment method on file will be charged for renewal within 24 hours prior to the end of the current period at the same rate
- Prices are subject to change; you will be notified in advance of any price increases
9.4 Cancellation
- iOS: Open Settings > [Your Name] > Subscriptions > Velko > Cancel Subscription
- Web: Manage your subscription through your Stripe billing portal
- Cancellation takes effect at the end of the current billing period; you retain access to premium features until then
- No partial refunds are issued for unused portions of a billing period
9.5 Refunds
- iOS purchases: Refunds are handled by Apple per their refund policy. To request a refund, visit reportaproblem.apple.com
- Web purchases: Refunds for Stripe subscriptions may be requested within 14 days of purchase by contacting support@velko.ai
10. Termination
- You may delete your account at any time through the app or by contacting us
- We may suspend or terminate your account if you violate these terms
- Upon termination, your right to use the Service ceases immediately
- We may delete your data in accordance with our Privacy Policy following account termination
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Velko LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Nutritional analysis will be accurate or complete
- The Service will meet your specific requirements
- Any defects in the Service will be corrected
12. Limitation of Liability
To the maximum extent permitted by law, Velko LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or $100, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless Velko LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of another party.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Santa Clara County, California.
15. Changes to These Terms
We may update these terms from time to time. We will notify you of significant changes through the app or via email. Your continued use of the Service after changes constitutes acceptance of the updated terms.
